By downloading, installing, or using the Finite mobile application (“App,” “Finite,” or “the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the App.
These Terms constitute a legally binding agreement between you (“User,” “you,” or “your”) and Cankat Saraç (“we,” “us,” or “our”), the developer and operator of Finite.

Finite is not a medical device, clinical diagnostic tool, health monitoring system, or substitute for professional medical advice. Finite has not been reviewed, cleared, or approved by any medical regulatory authority, including but not limited to:
The “days remaining” figure displayed in Finite is a statistical estimate generated by applying publicly available actuarial life expectancy tables to the information you provide. It represents the statistical average for a population cohort sharing similar characteristics — not a prediction of your individual lifespan.
Your actual lifespan may be significantly shorter or longer than the estimate for reasons that cannot be captured by any statistical model.
Nothing in Finite constitutes:

Finite presents content relating to mortality, the finite nature of human life, and personal legacy. This content is intended to inspire reflection and mindfulness. However:

Finite is a mobile application that:
You must be at least 13 years old to use Finite. By using the App, you represent and warrant that you meet this age requirement. Users in the European Economic Area (EEA) must be at least 16 years old, or must have verifiable parental or guardian consent.
By using Finite, you represent that you have the legal capacity to enter into these Terms in your jurisdiction.
You agree that your use of Finite complies with all applicable laws, regulations, and rules in your jurisdiction.
You retain full ownership of all content you create within Finite, including:
All content you create in Finite is stored exclusively on your device. We do not access, read, copy, or process any of your user-generated content. You are solely responsible for the security of your device and the content stored on it.
You are solely responsible for the accuracy, legality, and appropriateness of the health and personal information you enter. Providing false information will result in inaccurate estimates.
If you add family member profiles, you represent that:
You are responsible for obtaining any necessary consent from third parties before entering their personal information into the App.
Finite offers a “Finite Premium” subscription that unlocks the following features beyond those available in the free tier:

Prices are displayed in your local currency within the App and are subject to change with advance notice.
Subscriptions are billed through the platform store (Apple App Store or Google Play Store). Payment is charged to your store account upon purchase confirmation. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
Your account will be charged for renewal within 24 hours prior to the end of the current billing period.
To cancel your subscription, manage it through your platform’s subscription settings:
Cancellation takes effect at the end of the current billing period. You retain premium access through the end of the period you have paid for.
All purchases are subject to the refund policies of the applicable platform store (Apple App Store or Google Play Store). We do not independently process refunds. To request a refund:
If a free trial is offered, it will begin immediately upon enrollment. If you do not cancel before the trial period ends, you will be charged for the selected subscription plan.
We reserve the right to adjust subscription prices. You will be notified of price changes through the platform’s standard notification mechanisms. Continued use after a price change constitutes acceptance of the new pricing.
All elements of Finite — including but not limited to the App’s code, design, graphics, animations, actuarial logic, prompts, and copy — are the intellectual property of Cankat Saraç and are protected by applicable copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use Finite on your personal device for personal, non-commercial purposes, subject to these Terms.

Finite is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not warrant that:
The estimate is inherently imprecise and subject to the limitations of population-level statistical models.
We are not liable for any health decisions, lifestyle changes, financial decisions, estate planning decisions, or any other action or inaction that you take based on information provided by Finite.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CANKAT SARAÇ, HIS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY:
WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR USD $10.00, WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability, so some of the above limitations may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
If you are a consumer in the European Union, nothing in these Terms affects your statutory rights under mandatory EU consumer protection law, including rights under the EU Consumer Rights Directive or applicable national consumer protection legislation.
You agree to indemnify, defend, and hold harmless Cankat Saraç, his affiliates, and their respective directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:
Finite uses RevenueCat for subscription management. Your use of in-app purchases is also subject to the terms and conditions of the applicable platform store (Apple App Store or Google Play). These are third-party services over which we have no control. We are not responsible for the practices, content, or availability of third-party services.
We reserve the right to modify, suspend, or discontinue Finite or any part of it at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation.
We may revise these Terms at any time. Material changes will be communicated via in-app notice on next launch. Continued use of Finite after the effective date of revised Terms constitutes your acceptance of the changes.
If you do not agree with revised Terms, you must discontinue use and uninstall the App.
You may terminate these Terms at any time by uninstalling the App.
We reserve the right to terminate or suspend your access to the App at any time, with or without cause, including for violation of these Terms. Because Finite does not require an account, “termination” in practice means we may release App updates that prevent use of prior versions, or withdraw the App from distribution platforms.
These Terms are governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.
Before filing any formal legal claim, you agree to contact us at cankatsarac@gmail.com and attempt to resolve the dispute informally for at least 30 days.
For users outside the European Union, any dispute not resolved informally shall be submitted to binding individual arbitration under the Rules of the Istanbul Arbitration Centre (ISTAC), conducted in Istanbul, Turkey. You waive any right to participate in class action litigation or class arbitration.
If you are a consumer in the EU or EEA, you have the right to bring proceedings before the courts of your country of residence, and the mandatory consumer protection laws of your country may apply. The EU Online Dispute Resolution platform is available at: https://ec.europa.eu/consumers/odr
These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding Finite and supersede all prior agreements.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Our failure to enforce any right or provision in these Terms does not constitute a waiver of that right or provision.
You may not assign or transfer these Terms or any rights under them without our prior written consent. We may freely assign these Terms.
Nothing in these Terms creates any partnership, joint venture, employment, or agency relationship between you and us.
